Title 26 Guardian ad Litem Investigations

When faced with the diversity and complexity of issues brought by family law cases such as divorce (dissolution), parenting plans or other major changes in a relationship involving children, courts usually can’t get enough information to make decisions in the short time they have when working directly with parents. In WA State, Title 26 Guardians ad Litem are often assigned to investigate specific issues raised by a family court process and to provide reports so that the court can make more informed decisions. In some cases, a GAL will make recommendations to the court regarding aspects of a proposed parenting plan. Only the parties in the case or the court can make legally binding decisions for a family. Typically, when family issues are brought to the court for resolution, specific topics of concern need further investigation. When a GAL is assigned in a case, we are given specific criteria to investigate which relate to specific laws that were created to inform the court about what might be in the best interest of children. The job of the GAL is to investigate objectively and to provide information to the family and to the court. We aren’t here to judge, to make decisions or to share your personal information outside of the court.

Please note that GAL’s are appointed through a court order either by agreement of the parties or appointment by the court when the parties are not in agreement. Please contact your attorney or Court if you are trying to have a GAL appointed to your case.
